Terms of Service
These Terms govern your use of LocalBigFish (the "Portal") and the Google Business Profile services delivered through it. By creating an account, connecting a Google Business Profile, or paying for the service, you agree to these Terms.
1. What the service is
The Portal helps you build and publish the categories and service listings on your Google Business Profile. We read your existing listing, research and propose replacements, and — once you have approved them — write those approved categories and service items back to the location you selected using the Google Business Profile APIs.
We modify only the categories and service items fields of the location you select. We do not modify your business name, address, phone number, hours, photos, reviews, posts, or any other part of your profile.
2. Your authorization
By connecting a Google Business Profile you confirm that:
- You own the business, or you are authorized by the business owner to manage its Google Business Profile;
- You authorize LocalBigFish to act as your authorized representative for the limited purpose described in section 1;
- The information you give us about your business is accurate, and the services you ask us to list are services the business genuinely provides.
Your authorization is granted through Google's own consent screen when you sign in. We do not have, and will not request, access to your Google account by any other means. We will never ask you for your Google password.
3. Approval gates — nothing publishes without you
The Portal will not write anything to your Business Profile until you have approved it. Each stage of the process ends in an explicit sign-off, and the publish step presents a line-by-line comparison of your current listing against the proposed listing. Your approval is recorded with a timestamp.
Important — service items are replaced, not merged. The Google Business Profile API replaces a location's entire service list in a single operation. Any service currently on your profile that does not appear in the approved list will be removed when we publish. We take a full backup of your existing categories and service items immediately before every publish so that any change can be reversed on request.
4. Change notifications
We will notify you by email within 48 hours of any change we make to your Business Profile. That notice is sent separately from any other correspondence and describes exactly what changed.
5. Your responsibilities
- Review what we propose. You are responsible for the accuracy of what is published about your business.
- Do not ask us to list services your business does not provide, or to use categories that misrepresent your business. We will decline such requests, as they violate Google's own content policies and can result in your profile being suspended.
- Keep your Portal account credentials secure and tell us promptly if you believe they have been compromised.
- Maintain your own eligibility to have a Google Business Profile. We are not responsible for suspensions arising from facts about your business that are outside our control.
6. Fees and payment
Fees, billing frequency and what is included are set out at the point of purchase. Payments are processed by Stripe; we do not store your card details. Unless stated otherwise in writing, fees are payable in advance and are non-refundable once work on an engagement has begun, except where required by law. Recurring plans renew automatically until cancelled and may be cancelled at any time, effective at the end of the current billing period.
7. No guarantee of results
Local search rankings are determined by Google using signals we do not control, and Google may reject, alter or remove any listing content at its discretion. We apply established local SEO practice and our own research, but we do not guarantee any particular ranking, volume of calls, leads, or revenue, and nothing in our marketing should be read as such a guarantee.
8. Relationship to Google
LocalBigFish is an independent service provider. We are not affiliated with, endorsed by, or sponsored by Google LLC. Google, Google Business Profile, and related marks are trademarks of Google LLC. Your Google Business Profile remains subject to Google's own terms and content policies, which take precedence over anything in these Terms.
9. Term, termination and handback
- Either party may terminate at any time on written notice.
- You may revoke our access to your Google account at any moment at myaccount.google.com/permissions, without notice to us.
- On termination we revoke our own access and return exclusive control of your Business Profile to you within seven business days.
- On request at or after termination, we will provide the most recent backup of your listing that we still hold, and confirm deletion of your data.
- All work published before termination remains on your profile and is yours to keep or change.
10. Data
Our handling of your information, including data received from Google APIs, is described in our Privacy Policy, which forms part of these Terms. In short: Business Profile content is retained no longer than 30 calendar days, is never sold or transferred for advertising, and is never used to train AI models.
11. Limitation of liability
To the fullest extent permitted by law, LocalBigFish's total liability arising out of or relating to the service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or business opportunity. Nothing in these Terms limits liability that cannot be limited by law.
12. Indemnity
You agree to indemnify LocalBigFish against claims arising from information you provided or approved that turns out to be inaccurate, misleading, or infringing, or from your lack of authority to manage the Business Profile you connected.
13. Changes to these Terms
We may update these Terms. Material changes will be notified by email at least 14 days before they take effect. Continued use after that date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the State of California, and the parties submit to the exclusive jurisdiction of the state and federal courts located in [INSERT COUNTY] County, California.
